Terms of Service

Effective Date:  August 29, 2025

These Terms of Use (the “Terms”) govern your access to and use of Hausflow (the “App,” “Site,” or “Service”), provided by Taylor & Ash Co, LLC, a Texas limited liability company (“Hausflow,” “we,” “our,” or “us”).

By accessing or using Hausflow, you agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree, you may not use Hausflow.

1. Definitions
  • Hausflow: the SaaS platform, including hausflow.co, hausflow.ai, subdomains, mobile apps, APIs, dashboards, and related services.
  • Content: all materials provided by Hausflow, including software, source code, text, images, templates, videos, graphics, AI-generated outputs, and training resources.
  • User / You: any individual or entity that visits, registers for, or subscribes to Hausflow.
  • User Content: materials uploaded or provided by Users (photos, scripts, captions, MLS details, feedback, testimonials).
  • Generated Content: content produced by Hausflow’s AI tools or automated systems.

2. Eligibility
  • You must be at least 18 years old.
  • You must have authority to form a binding contract.
  • You may not use Hausflow if barred under U.S. law or sanctions.
  • By creating an account, you represent you are using Hausflow for lawful business purposes, not for resale or redistribution.

3. Acceptance of Terms
By using Hausflow, you accept these Terms and all referenced policies. If you use Hausflow on behalf of an entity, you confirm you have authority to bind that entity.

4. Important Information for California Residents
Pursuant to California Civil Code §1789.3, California residents are entitled to the following consumer rights notice:

In addition, California residents should note the following:
  1. Governing Law & Disputes-Any dispute between you and Hausflow will be governed by the laws of the State of Texas and resolved pursuant to the “Dispute Resolution” section below.
  2. Limitations on Warranties and Damages-Under California law, certain disclaimers of warranties and limitations of liability in these Terms — including those in the “Disclaimers of Warranties” and “Limitations of Liability” sections — may not apply to you.
5. Important Information for New Jersey Residents
If you live in New Jersey, by using Hausflow, creating an account, or purchasing a subscription, you agree:

  1. Governing Law & Disputes-Any dispute between you and Hausflow will be governed by Texas law and subject to the “Dispute Resolution” section below.
  2. Limitations on Warranties and Damages-Under New Jersey law, certain provisions in these Terms — including those in the “DMCA / Copyright Policy,” “Disclaimers of Warranties,” “Limitations of Liability,” and “Unauthorized Use” sections — may not apply to you.
  3. Responsibility for Harm-As set forth in the “Indemnification” section, you are responsible for any harm you cause Hausflow, including:  
  • (i) User Content you provide,
  • (ii) Violations of laws (MLS, fair housing, advertising, etc.),
  • (iii) Breaches of these Terms,
  • (iv) Infringement of intellectual property, and
  • (v) Activities under your account, even if unauthorized.

6. International Users
Hausflow is operated from Texas, USA. We make no representation that Hausflow is appropriate outside the United States. If you access Hausflow abroad, you are responsible for compliance with local laws. Hausflow may not be used in violation of U.S. export or sanctions laws.

7. Governing Law
These Terms and any dispute arising out of or related to your use of Hausflow shall be governed by the laws of the State of Texas, without regard to conflict of law principles. Except where arbitration applies, the exclusive venue for any permitted legal action is the state or federal courts located in Lubbock County, Texas, and you consent to their jurisdiction. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.

8. Changes to Terms
We may revise these Terms at any time. The “Last Updated” date reflects the most recent version. Continued use after changes constitutes acceptance.

9. Accounts
  • Registration may be required to access certain features.
  • You must provide accurate and complete information.
  • You are responsible for safeguarding your account and all activity under it.
  • Sharing or reselling accounts is prohibited.
  • Hausflow may suspend or terminate accounts for violations, nonpayment, or fraudulent activity.

10. Privacy
Use of Hausflow is governed by our Privacy Policy. By using Hausflow, you consent to our data practices. Users remain responsible for compliance with privacy obligations related to their clients’ information.

11. Rules of Conduct
  • You agree not to:
  • Use Hausflow unlawfully or for prohibited purposes.
  • Upload or distribute malicious code or spam.
  • Scrape, reverse-engineer, or attempt to copy the design, features, source code, models, or proprietary systems of Hausflow.
  • Resell, redistribute, or replicate Hausflow’s platform, outputs, or intellectual property for use in competing products or services.
  • Misrepresent AI-generated content as exclusive or original work when created using Hausflow.
  • Post User Content that infringes IP, violates MLS or fair housing laws, or is misleading/defamatory.
12. Intellectual Property
  1. Ownership of Hausflow Content-All rights, title, and interest in Hausflow, including the software, source code, algorithms, AI models, designs, templates, user interface, trade dress, graphics, logos, trademarks, service marks, and all other proprietary materials (collectively, “Hausflow Content”), are and will remain the exclusive property of Taylor & Ash Co, LLC.  Nothing in these Terms transfers any ownership rights to you.
  2. License to Use Generated Content-Subject to your compliance with these Terms, Hausflow grants you a limited, non-exclusive, non-transferable, revocable license to use AI-generated marketing copy, captions, hashtags, and other outputs (“Generated Content”) solely for your own professional marketing and business purposes.  This license does not allow you to resell, sublicense, or commercially redistribute Generated Content as part of any product, platform, or service competing with Hausflow.
  3. Restrictions-You agree not to: Copy, reproduce, modify, reverse-engineer, or create derivative works based on Hausflow Content.
  4. Use Generated Content or Hausflow Content to build, train, or improve any competing AI models, services, or products.  Remove, obscure, or alter any copyright, trademark, or proprietary rights notices contained in Hausflow.
  5. Reservation of Rights-Hausflow reserves all rights not expressly granted to you under these Terms.  Any unauthorized use of Hausflow Content or Generated Content terminates the license granted herein and may subject you to legal action.
  6. Proprietary Rights in Feedback-If you submit ideas, suggestions, feedback, or recommendations (“Feedback”) regarding Hausflow, you acknowledge and agree that: (i) such Feedback is not confidential, (ii) you have no expectation of compensation, and (iii) Hausflow is free to use, implement, and incorporate such Feedback into its products and services without restriction or obligation to you.

13. User Content
  • You retain ownership of your User Content.
  • By uploading, you grant Hausflow a license to host, display, and use it to operate and improve the Service.
  • You grant permission for testimonials and feedback to be used in marketing.
  • You are responsible for compliance with advertising, MLS, and fair housing laws.
  • We may remove User Content that violates these Terms.
  • We do not guarantee permanent storage of User Content.

14. DMCA / Copyright Policy
Hausflow respects intellectual property rights. If you believe your work has been copied in a way that constitutes copyright infringement, send a notice to support@hausflow.co including:
  • Identification of copyrighted work,
  • Identification of infringing material,
  • Your contact information,
  • A statement of good faith belief,
  • A statement under penalty of perjury that you are authorized,
  • Your signature.
We may remove infringing material and terminate repeat offenders.

15. Subscription & Billing
  • Hausflow subscriptions are billed automatically (monthly or annual).
  • Fees are shown at checkout and may change with notice.
  • Subscriptions renew unless canceled before renewal.
  • Cancellations may be submitted in-app, via the App Store, or by emailing support@hausflow.co.
  • Due to the digital nature of our service, all sales are final except where required by law.
16. Unauthorized Use
You may not:
  • Share or resell Hausflow access outside your licensed account.
  • Circumvent subscription limits.
  • Use outputs for competing products.

17. Service Availability
  • We strive for reliability but do not guarantee uninterrupted access.
  • Beta features may include bugs, downtime, or data loss.
  • We are not responsible for outages caused by hosting providers, cyberattacks, or force majeure events.

18. Disclaimers of Warranties
Hausflow is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
  • AI-Generated Content-Generated Content may contain errors, omissions, or inaccuracies, and may not comply with MLS, NAR, fair housing, or local/state advertising regulations. You are solely responsible for reviewing and editing all Generated Content before publishing or relying on it. Hausflow does not guarantee originality, freedom from infringement, or suitability of Generated Content.
  • Third-Party Integrations-Hausflow may integrate with third-party services (e.g., Stripe, Apple, Google, MLS feeds, social media APIs). We make no warranties regarding the reliability, security, or performance of these third-party services. Hausflow is not responsible for downtime, errors, data loss, or inaccuracies caused by third-party providers.
  • No Reliance Guarantee-Any reliance on Generated Content or integrations is at your own risk. Hausflow is not liable for regulatory actions, fines, or reputational harm from use of Generated Content.

19. Limitation of Liability
To the fullest extent permitted by law:
  • Hausflow’s total liability will not exceed the fees you paid in the past 12 months.
  • We are not liable for lost profits, reputational harm, regulatory fines, or data loss.

20. Indemnification
You agree to indemnify Hausflow, its affiliates, and representatives against claims, damages, or expenses resulting from:
  • Your misuse of the Service,
  • Your User Content,
  • Your violation of laws or regulations,
  • Your breach of these Terms.

21. Termination
Hausflow may suspend or terminate accounts at any time for violation of these Terms, nonpayment, or misuse. Termination ends your access. No refunds will be issued.
22. Third-Party Links & Services
Hausflow may integrate with or link to third-party services. We are not responsible for their terms, policies, or performance.

23. Dispute Resolution
Disputes will be resolved by binding arbitration in Lubbock County, Texas under JAMS rules. You waive jury trials and class actions. Exceptions: (i) small claims court, (ii) IP disputes.

24. Arbitration Rules
Arbitration follows JAMS Comprehensive or Expedited Procedures, available at www.jamsadr.com.

25. Arbitration Process
Before arbitration, you must send us a written notice of dispute to support@hausflow.co including your name, address, facts, and requested relief.

26. Arbitration Decision
The arbitrator’s decision is final and binding. Judgment may be entered in any competent court.

27. Time Limit on Claims
All claims must be filed within one (1) year of arising. Claims filed after this period are permanently barred.

28. General Terms
  • These Terms are the entire agreement between you and Hausflow.
  • If any provision is invalid, others remain enforceable.
  • Force majeure events excuse performance.
  • English controls if translated.
  • We may assign these Terms; you may not without consent.
